Scope of Services
C & L Sullivan Grading & Excavation provides site preparation and earthmoving services, which may include but are not limited to:
- Storm damage repair and land restoration
- Commercial clearing
- Sewer installation and repairs
- Mass commercial grading
- Water service installation and backflow prevention
- Advanced underground stormwater system design and installation
All services will be performed according to industry standards, applicable codes, and agreed project specifications.
Quotes, Estimates, and Proposals
- Any quotes or estimates provided by our company are valid for 30 days unless otherwise stated.
- Estimates are based on the information provided by the Client at the time of request. Final pricing may vary depending on unforeseen site conditions, material availability, or scope changes.
- Clients will be notified quickly of any additional costs before such work is carried out.
Service Agreements & Contracts
- A written contract, work order, or signed proposal is required before work commences.
- By signing a service agreement or accepting a quote, you confirm that you have the authority to contract services for the property in question.
- Changes to the contract scope must be documented in writing and signed by both parties.
Client Responsibilities
As our Client, you agree to:
- Provide accurate information about the project site and any known hazards.
- Obtain all necessary permits, approvals, and authorizations required by local authorities unless otherwise agreed in writing.
- Ensure safe and reasonable access to the project site for our equipment and crews.
- Remove any obstacles, personal property, or materials that may interfere with our work unless otherwise contracted.
Failure to meet these responsibilities may result in project delays or additional costs.
Site Conditions & Unforeseen Circumstances
- C & L Sullivan Grading & Excavation is not responsible for concealed or unknown conditions, such as underground utilities, hazardous materials, or unstable soil, unless disclosed prior to project commencement.
- If unforeseen conditions arise, we will notify the Client immediately. Any additional work or delays caused by such conditions will be billed at agreed rates.
- The Client is responsible for identifying and marking underground utilities unless we are specifically contracted to coordinate with local utility companies.
Cancellations & Rescheduling
- Clients may cancel or reschedule a project by providing at least 7 business days’ notice in writing.
- Deposits may be forfeited if cancellation occurs after mobilization or if materials have been purchased specifically for the project.
- Weather-related delays or conditions outside of our control may require rescheduling. We will coordinate with the Client to minimize disruptions.
Warranties & Liability
- We warrant that our services will be carried out in a professional and workmanlike manner consistent with industry standards.
- We do not guarantee outcomes affected by factors outside of our control, including natural disasters, erosion, flooding, or subsequent third-party work on the site.
- To the fullest extent permitted by law, our liability is limited to the value of the contract. We are not liable for indirect, incidental, or consequential damages.
Equipment & Property Use
- Heavy equipment may cause unavoidable ground disturbance. The Client acknowledges and accepts this as part of the excavation and grading work.
- C & L Sullivan Grading & Excavation will not be held responsible for damage to driveways, lawns, or underground utilities not properly marked or disclosed by the Client.
- Clients should take reasonable steps to protect personal property and landscaping during the project.
Safety & Compliance
- The Client agrees not to interfere with work areas or enter restricted zones while our crews are operating equipment.
- If unsafe conditions are identified, we reserve the right to halt work until those conditions are resolved.
Force Majeure
We are not liable for delays, interruptions, or failure to perform services caused by events beyond our control, including severe weather, natural disasters, labor disputes, supply shortages, or government actions.
Intellectual Property & Website Use
- All website content, including text, graphics, logos, and images, is the property of C & L Sullivan Grading & Excavation and may not be copied, reproduced, or distributed without permission.
- Unauthorized use of our website or misrepresentation of our brand is strictly prohibited.
Confidentiality
Both parties agree to maintain the confidentiality of proprietary information, pricing, and project details unless disclosure is required by law or mutually agreed upon.
Governing Law & Dispute Resolution
- These Terms & Conditions are governed by the laws of the State of Georgia.
Amendments & Updates
We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Updated versions will be posted on our website with a revised “Last Updated” date.
